These Terms of Use (“Terms”) govern your access to and use of letitunfold.ca (the “Website”), operated by Unfold Creative Studio Ltd., a company based in Toronto, Ontario, Canada (“Unfold Creative Studio,” “Unfold,” “we,” “us,” or “our”).
The Website provides information about our residential and commercial interior design services and includes an online store through which we sell digital design products, including AutoCAD dynamic blocks offered under our uDesign product line.
Please read these Terms carefully before using the Website or purchasing a digital product. By accessing or using the Website, creating an account, or purchasing a product through the Website, you agree to be bound by these Terms and any policies or additional terms expressly incorporated into them. If you do not agree with these Terms, you should not use the Website or purchase products through it.
1. About Our Website
The Website provides information about Unfold Creative Studio, our interior design work and services, and digital products available for purchase. Information presented on the Website is provided for general informational and promotional purposes and does not, by itself, create a professional, contractual or client relationship between you and Unfold Creative Studio.
The availability of particular services, products or Website features may change from time to time. We reserve the right to modify, suspend or discontinue any part of the Website, its content, products or functionality, subject to our obligations concerning purchases already completed and any rights available to you under applicable law.
2. Interior Design Services
Unfold Creative Studio provides residential and commercial interior design services.
Descriptions, photographs, portfolios, examples, estimates, general pricing information or other information concerning our services displayed on the Website are provided for general information only and do not constitute a binding proposal, quotation or agreement to provide services.
An inquiry, consultation request or other communication submitted through the Website does not create a client relationship or obligate Unfold Creative Studio to accept a project.
If Unfold Creative Studio agrees to undertake an interior design project, the scope of work, fees, payment terms, responsibilities, deliverables, timelines and other terms applicable to that engagement will be set out in a separate proposal, service agreement or other written agreement between Unfold Creative Studio and the client.
If there is any conflict between these Terms and a separately executed agreement governing interior design services, the terms of that separate agreement will govern the applicable professional engagement.
3. Website Content and Intellectual Property
Unless otherwise indicated, the Website and its content are owned by or licensed to Unfold Creative Studio Ltd. and are protected by Canadian and international intellectual-property laws.
This includes, without limitation, the Website’s design, layout, text, photographs, illustrations, graphics, logos, branding, project images, drawings, plans, digital files, videos, product images, product descriptions, software elements and other materials made available through the Website (“Website Content”).
Except as expressly permitted by these Terms or applicable law, you may not reproduce, copy, modify, republish, distribute, transmit, sell, license, publicly display, commercially exploit or create derivative works from Website Content without our prior written permission.
You may view and make reasonable personal use of publicly available Website Content for informational purposes.
Nothing in these Terms transfers ownership of any intellectual-property right belonging to Unfold Creative Studio or its licensors. All rights not expressly granted are reserved.
4. Portfolio and Project Content
Photographs, renderings, drawings, designs, floor plans, concepts and other materials appearing in our portfolio or elsewhere on the Website are provided to demonstrate our work and design capabilities.
You may not copy or use these materials as your own work, reproduce designs for commercial purposes, present them to another designer or contractor as your own design, or otherwise exploit them without authorization.
Certain photographs, products, artwork, furnishings or other materials appearing in project photography may be owned by third parties. Nothing on the Website grants you rights in third-party intellectual property.
5. Digital Products and uDesign
Unfold Creative Studio sells downloadable digital products, including AutoCAD dynamic blocks and related design resources offered through the uDesign product line. uDesign is a brand or product line of Unfold Creative Studio Ltd. Purchases of uDesign products through the Website are transactions with Unfold Creative Studio Ltd.
Digital products are licensed, not sold outright. Purchasing a digital product does not transfer ownership of the product, its source file, underlying design or associated intellectual-property rights.
Your purchase and use of a digital product are governed by our Digital Product Licence, which is incorporated into these Terms by reference.
Unless otherwise expressly stated for a particular product or agreed to in writing by Unfold Creative Studio, each standard licence is granted to one individual user for use on one device.
The Digital Product Licence describes permitted personal and professional use, use in client projects, additional users or devices, modifications, prohibited sharing and redistribution, intellectual-property ownership and other licence conditions.
You are responsible for reviewing the Digital Product Licence before purchasing or using a digital product.
6. Accounts
Certain Website features or purchases may permit or require you to create an account.
You are responsible for providing accurate and current information and for maintaining the confidentiality of your account credentials.
You are responsible for activity occurring through your account and should notify us promptly if you become aware of unauthorized access or use.
You may not create an account using false information, impersonate another person, use another person’s account without authorization or use an account for fraudulent or unlawful purposes.
We may suspend or restrict an account where we reasonably believe that the account has been compromised, used fraudulently, used to violate these Terms or an applicable Digital Product Licence, or used in a manner that threatens the Website or our rights.
7. Product Information and Compatibility
We make reasonable efforts to accurately describe our digital products, including their intended use, features, file formats and known compatibility requirements.
Before purchasing a digital product, you are responsible for reviewing the product description and ensuring that you have compatible software, hardware and sufficient technical knowledge to use the product.
Unless expressly stated otherwise on the applicable product page, the purchase of a digital product does not include AutoCAD or other third-party software, installation services, customization, training or ongoing technical support.
Examples, previews, screenshots, videos or demonstrations are provided to illustrate the product and may appear or operate differently depending on your software version, configuration, device or project environment.
8. Orders and Payment
Prices displayed on the Website are stated in Canadian dollars (CAD) unless otherwise indicated.
Applicable taxes will be calculated and charged where required by law.
Payment is processed through third-party payment providers. The payment methods available to you will be displayed during checkout and may include PayPal, debit or credit cards, Apple Pay or other available payment methods.
You agree to provide accurate and complete information necessary to process your transaction.
We reserve the right to refuse or cancel an order where we reasonably suspect fraud, unauthorized payment activity, pricing or technical error, unauthorized resale or redistribution, violation of these Terms or unlawful activity.
If payment is made in a currency other than Canadian dollars, your payment provider or financial institution may perform currency conversion and may charge conversion or transaction fees. We do not control those exchange rates or fees.
9. Taxes
Purchases may be subject to applicable sales, value-added or similar taxes depending on the nature of the transaction and applicable law.
Where Unfold Creative Studio is legally required to collect a tax, the applicable amount will be added to the transaction.
You are responsible for any taxes, duties, charges or reporting obligations imposed directly on you that Unfold Creative Studio is not required to collect or remit on your behalf.
10. Digital Delivery, Cancellations and Refunds
Digital products are delivered electronically and may be made available automatically following successful payment through a download link, customer account, order confirmation or another electronic delivery method.
Because digital products provide access to downloadable content, sales are generally final and non-refundable once the purchased product has been made available for download or access, except where a refund, cancellation or other remedy is required by applicable law.
Our Refund & Digital Delivery Policy, which is incorporated into these Terms by reference, contains the complete terms governing digital delivery, download problems, cancellations, refunds, corrupted or missing files, compatibility issues, duplicate purchases, payment disputes and related matters.
You are responsible for reviewing the Refund & Digital Delivery Policy before completing your purchase.
Nothing in these Terms or the Refund & Digital Delivery Policy limits any right or remedy that cannot lawfully be excluded or waived under applicable law.
11. Product Updates and Support
Unless expressly stated otherwise at the time of purchase, purchasing a digital product does not entitle you to future updates, new versions, modifications, customization, training or indefinite technical support.
We may choose to update, correct, improve or discontinue a digital product at any time.
Discontinuing or modifying a product does not affect a licence applicable to a copy that you lawfully purchased and retained, subject to the applicable Digital Product Licence.
Where a purchased file is corrupted, materially incomplete or inaccessible because of a problem with the file or its delivery, we will make reasonable efforts to assist as described in our Refund & Digital Delivery Policy.
12. Prohibited Use of the Website
You may not use the Website for an unlawful, fraudulent or abusive purpose or in a manner that infringes the rights of Unfold Creative Studio or another person.
You may not attempt to gain unauthorized access to the Website, another user’s account, our servers or connected systems; interfere with Website operation or security; introduce malware or malicious code; scrape or systematically extract Website Content for unauthorized commercial purposes; circumvent technical restrictions; impersonate another person; collect personal information from Website users without authorization; or use Website Content or digital products in violation of our intellectual-property or licence rights.
You may not use automated systems in a manner that places an unreasonable burden on the Website or interferes with its normal operation.

16. Digital Product Disclaimer

Unless expressly stated otherwise, our digital products are not engineering drawings, architectural certifications, construction documents or representations that a particular design complies with applicable building codes, regulations, standards, manufacturer specifications or site conditions.
You remain responsible for professional judgment, project-specific verification and obtaining any professional review, approvals or certifications required for your project.
17. No Warranties
To the fullest extent permitted by applicable law, the Website, Website Content and digital products are provided on an “as is” and “as available” basis.
Unfold Creative Studio does not warrant that the Website or its digital products will be uninterrupted or error-free, or that every digital product will be compatible with every software version, system, configuration or intended application.
Any warranties, conditions or representations that cannot legally be excluded remain unaffected.
18. Limitation of Liability
To the fullest extent permitted by applicable law, Unfold Creative Studio Ltd. and its directors, officers, employees and representatives will not be liable for indirect, incidental, special, exemplary, punitive or consequential damages, loss of profits, loss of revenue, loss of business opportunity, loss of data or similar losses arising from or relating to the Website, Website Content or digital products.
With respect to a purchased digital product, and to the fullest extent permitted by applicable law, Unfold Creative Studio’s aggregate liability arising from or relating to that product will not exceed the amount actually paid to Unfold Creative Studio for the product giving rise to the claim.
These limitations do not apply to liability that cannot lawfully be excluded or limited.
Nothing in these Terms limits rights or remedies available to a consumer that cannot legally be waived under applicable law.
19. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Unfold Creative Studio Ltd. and its directors, officers, employees and representatives from third-party claims, liabilities, damages, losses and reasonable costs arising from your unlawful use of the Website or digital products, your infringement of another person’s rights, your unauthorized distribution or exploitation of a digital product, or your material violation of these Terms or an applicable Digital Product Licence.
This indemnification does not apply to the extent that a claim results from Unfold Creative Studio’s own conduct for which liability cannot lawfully be excluded.
20. Enforcement of Intellectual-Property and Licence Rights
Unauthorized copying, sharing, resale, distribution or other exploitation of our Website Content or digital products may cause harm for which monetary damages alone may not provide an adequate remedy.
Where permitted by law, Unfold Creative Studio may seek injunctive or other equitable relief to prevent or stop actual or threatened infringement of its intellectual-property or licence rights, in addition to any other remedies available to it.
Termination of your account or access does not eliminate obligations or liabilities arising from unauthorized use or distribution occurring before termination.
21. Suspension and Termination
We may suspend or terminate access to an account or Website functionality where we reasonably believe you have materially violated these Terms or an applicable Digital Product Licence, engaged in fraudulent or unlawful activity, compromised Website security or infringed our intellectual-property rights.
Termination or suspension does not grant you the right to redistribute digital products previously obtained and does not terminate provisions of these Terms or an applicable Digital Product Licence that by their nature are intended to continue.
22. Privacy and Cookies
Our collection, use and disclosure of personal information in connection with the Website is described in our Privacy Policy.
Our use of cookies and similar technologies is described in our Cookie Policy.
The Privacy Policy and Cookie Policy should be read together with these Terms but govern privacy and cookie matters respectively.
23. Additional Policies
Purchases and use of digital products are also subject to our Digital Product Licence and Refund & Digital Delivery Policy.
These policies form part of the terms applicable to digital product purchases and are incorporated into these Terms by reference.
Where a particular product is expressly offered subject to additional or product-specific terms, those terms also apply to that product.
24. Separate Agreements
You may enter into a separate proposal, service agreement, licence agreement or other written agreement with Unfold Creative Studio Ltd.
These Terms govern general Website use and purchases made subject to them.
Where a separately executed written agreement governs a particular interior design engagement or other service and conflicts with these Terms, the separate agreement will govern that engagement to the extent of the conflict.
The Website Terms do not expand or modify the scope of services promised under a separate client agreement.
25. Changes to These Terms
We may update these Terms from time to time to reflect changes to the Website, our products, business practices or applicable requirements.
Updated Terms will be published on the Website with a revised “Last Updated” date.
Changes will apply prospectively unless otherwise permitted by law and will not retroactively remove rights already accrued under a completed transaction or separate agreement.
26. Governing Law and Jurisdiction
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.
Subject to any rights or jurisdictional protections that cannot lawfully be waived, disputes arising from these Terms, the Website or digital products will be subject to the jurisdiction of the courts located in Ontario, Canada.
Nothing in these Terms prevents Unfold Creative Studio from seeking injunctive or other appropriate relief in another jurisdiction where reasonably necessary to protect or enforce its intellectual-property rights.
27. General Provisions
If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary to make it enforceable where possible, and the remaining provisions will continue in effect.
Our failure to enforce a provision of these Terms on one occasion does not waive our right to enforce that provision or another provision later.
You may not assign or transfer your rights under these Terms or an applicable Digital Product Licence without our prior written consent.
Headings are included for convenience and do not affect interpretation.
These Terms, together with the policies and additional terms expressly incorporated into them and any applicable separate agreement, constitute the agreement governing the matters addressed by them.
